TERMS AND CONDITIONS
This document contains a summary of some of the Rental Conditions. For full detailed Conditions refer to the Conditions schedule in the Rental Agreement. Please note all prices quoted in this document are in Australian dollars. Rates and Conditions quoted in our brochures and/or documentation are subject to change without notice.

RENTAL DURATION

• Rental days are calculated on a 24 hour basis. 
• Minimum rental period is 1 day for car rentals.
• Minimum rental periods apply to one way rentals between cities. Refer to One Way Rentals section.
• Minimum rental periods are subject to change during peak periods.
• Early return of vehicle does not entitle the hirer to any refund of the unused portion of the rental.

Maui allows a grace period of 59 minutes before the hirer is liable for late return charges. Late return fees are applicable as follows:

1 hour late, one third of the daily rate will apply
2 hours late, two thirds of the daily rate will apply
3 hours late, one full day rate will apply

ONE-WAY RENTALS

One-way rentals are available between all branch locations (excluding between Tasmania and the mainland). One-way rental fees and minimum rental periods will apply. 

Pick-up or drop-off in Adelaide, Brisbane, Cairns, Melbourne, Sydney = No one-way fee / 7 day minimum period

Pick-up or drop-off in NT (Alice Springs, Darwin) and WA locations (Perth, Broome) = One-way fee $500 / 10 days minimum rental period

One-way rentals between Hobart and the mainland are not permitted.

The one-way fee is in addition to the Broome surcharge fee if applicable.

MULTIPLE RENTALS*
(Refer to Flex Section if applicable)

Should a customer have more than one rental (multiple rentals) a customer can combine all rentals to qualify for our long term rate, if applicable. Campervan and car rentals in Australia, South Africa and New Zealand, for both Britz and Maui, can be combined to qualify if the time lapsed between hires is less than 3 months. e.g. One 14 day rental plus one 7 day rental, less than 3 months apart, qualifies for the 21 day rate.

The One Way Fee (if applicable) and charges for additional hire equipment and additional extras
(including excess reduction coverage) will be charged per vehicle rented.

BRANCH HOURS FOR PICK-UP AND DROP-OFF

Adelaide, Alice Springs, Brisbane, Broome, Cairns, Darwin, Hobart, Melbourne, Perth, Sydney: Daily from 0800 to 1700, closed Christmas Day (25th December).

Maui requests for clients collecting or returning their vehicles to be in the office by 1430.

Pick-ups and drop-offs after branch hours may be available by prior arrangement. Late returns will be charged on a per day basis.

BRANCH HOURS AND CONTACT DETAILS FOR RESERVATIONS

Daily from 0700 to 1800, closed Christmas Day (25th December)

RENTALS IN BROOME:  

An additional remote location fee of AU$400 applies to all rentals picking up or dropping off (or both) in Broome. Only one remote location fee is charged per vehicle. This is in addition to the One-Way fee if applicable.

AIRPORT CONCESSION FEE
An airport concession fee will be charged for hires that pick-up from airport locations. 

An airport pick-up fee of 4% of the total hire cost will apply for hires with pick-up at Hobart airport. This fee is subject to change. 
 
FOR YOUR PROTECTION
Personal Injury is covered in most cases through Registration Third Party Insurance. We strongly recommend that all people travelling in Australia take out Personal Travel Insurance.
All vehicles are insured for any damage to the vehicle or to the property of a Third Party.  The hirer is responsible for the first $2,000 for Rental Cars of the cost of damage to Third Party property or to the rented vehicle, including single vehicle accident, windscreen and tyre damage and underbody damage, towing and recovery costs, theft, fire, break-in or vandalism.  This also includes the cost of the daily rental for the period the vehicle is off fleet for accident repairs (demurrage).

The excess applies in respect of each claim, not rental.

The excess is applicable regardless of who is at fault and must be paid at the time the accident report is completed, or at the completion of the rental, whichever occurs first.  The excess will be refunded to the hirer if we are successful in recovering the cost of the damages from the Third Party. Please note that Third Party Claims can take months to resolve.

Please see the Exclusions section below, whereby all Excess Reduction cover will be made void.

This excess can be reduced, in most circumstances, by the purchase of the Excess Reduction Option for Rental Cars.

Excess Reduction Option

With Excess Reduction the hirer is responsible for the first $220 (2WD cars) of ANY ACCIDENT COST of damage to Third Party property or to the rented vehicle, including single vehicle accident, underbody damage, towing and recovery costs, theft, fire, break in or vandalism. This also includes the cost of the daily rental rate for the period the vehicle is off fleet for accident repairs (demurrage). The excess applies in respect of each claim, not rental.
Please see the ‘Exclusions’ section below, whereby all Excess Reduction cover will be made void.

Premium Cover Option

Where PCO is taken out at a flat rate of AU$40 per rental in addition to the Excess Reduction Option, the hirer will not have to pay any excess at all for any damage to the vehicle or property of a third party.

MAUI STRONGLY RECOMMENDS OUR CUSTOMERS TO TAKE THE EXCESS REDUCTION OPTION FOR TRAVEL WITH COMPLETE PEACE OF MIND.

EXCLUSIONS:
The Excess Reduction Option and PCO for Rental Cars does not cover:

1. Any water related damage, which includes but is not limited to:
 a) any vehicle submersion
 b) creek or river crossing
 c) driving through low plain flooded areas
 d) beach driving

2. Personal belongings: we recommend the hirer does not leave valuables in the vehicle and that they take out personal insurance.

3. All Excess Reduction is void if the terms of the Rental Agreement are breached. The hirer will be responsible for the total cost of any damage.  This will also include any damage caused by willful misconduct (e.g. sitting or standing on the bonnet or roof of the vehicle) and driving under the influence of alcohol or drugs.

4. The cost to retrieve or recover a vehicle which has become bogged, regardless of the Excess Reduction Package taken.

5. The cost to replace keys which have become lost, or retrieval of keys which have been locked in a vehicle.

VEHICLE SECURITY DEPOSIT

On pick up of the vehicle, a Vehicle Security Deposit is payable.  The amount is determined by the Protection Package selected (refer to the “FOR YOUR PROTECTION” section). 

If you do not take Excess Reduction Option, the Security Deposit of $2,000  is payable by cash, travelers cheques or credit card.  If you pay by credit card, the Deposit  will be debited to your account immediately. If the deposit is paid by cash (including travelers cheques) a stringent cash qualification process will apply. The cash qualification process is not available to International residents. In the interests of expediency and convenience, Maui strongly recommends the use of a credit card  for the vehicle security deposit. Due to exchange rate fluctuations there could be some variance in the amount refunded compared to the amount initially charged. Maui does not accept any liability for variances up or down. 

If the Excess Reduction Option  has been taken the Security Deposit is $220 payable by cash, travellers cheques or credit card.  Should the Deposit be paid by cash, a cash qualification process will apply. If paid by credit card, authorisation will be gained.

INFRINGEMENTS
We reserve the right to charge the hirer for any speeding, parking or tollway fines, associated administration costs and/or accidents including third party property damage not reported on return of the vehicle. The administration fee per fine will be AU$60.

EXCHANGE RATE / CURRENCY VARIATIONS
All credit card transactions are conducted in Australian dollars. Due to exchange rate fluctuations there could be some variance in the amount refunded compared to the amount initially charged. Maui does not accept any liability for variances up or down.

CREDIT CARDS
If a credit card is presented as payment, the credit card holder will be jointly and severally liable as a customer. Preferred credit cards are Visa Card and MasterCard.

LICENCE
A full resident country drivers licence, held for at least one year, is to be presented at the time of rental. If the licence is not in English format, an international drivers licence is also required. 

AGE RESTRICTIONS
Drivers must be 21 years of age or over. A medical certificate stating that the customer is fit to drive the vehicle they have booked for the duration of the hire is required for drivers over the age of 75.

CHANGE OF DROP-OFF DESTINATION
If the hirer wishes to change the drop-off destination after the Rental has commenced, they must first obtain authorisation from the destination branch. Subject to the change being approved, an additional charge of up to AU$700 will apply.

RENTAL EXTENSION *
(Refer to Flex Section if applicable)
If the hirer wishes to extend the rental whilst on hire, they must first obtain authorisation from the destination branch. This is subject to availability. The extra cost of an extended rental must be paid by credit card over the telephone on confirmation of the rental extension. Failure to obtain authorisation will result in a daily fee of AU$150 in addition to the daily rate.

ROAD RESTRICTIONS
2 Wheel Drive vehicles must not be used by you or by any authorized driver (unless authorized by us in writing) on any unsealed road (being a road not sealed with a hard material such as tar, bitumen or concrete).  No vehicle may be used in off-road conditions.   Off road conditions include, but are not limited to: fire trails, beaches, sand, tracks, fields or paddocks. The only exception to this is reasonable use of access roads to recognised commercial campgrounds. 
Maui reserves the right at its sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions, and the distance to nominated destinations in relation to the length of the hire period.

ON-ROAD ASSISTANCE
Any problems associated with the vehicle, including equipment failure, must be reported as soon as possible, and within 24 hours in order to give the supplier the opportunity to rectify the problem during the rental. Failure to do so may compromise any claims for compensation.  We do not accept liability for any claims submitted after this period.

CHANGE OF VEHICLE
Should the vehicle booked be unavailable through unforeseen circumstances, Maui reserve the right to substitute an alternative vehicle without prior notification and at no extra cost.  This shall not constitute a breach of contract and does not entitle the hirer to a refund.

VEHICLE CATEGORY
Vehicles cannot be requested by make or model, only by vehicle category.

VOLUNTARY DOWNGRADE
Should the hirer decide to take a lesser vehicle than booked they will not be entitled to any refunds.

CANCELLATION FEE
The cancellation fees are:

TAXES
A charge of 2% of the total cost will be levied to cover state government taxes, duties and associated cost. This is payable upon collection of the vehicle.

IMPORTANT
Maui reserves the right to refuse any rental at its discretion.

ANIMALS
No animals are permitted in our vehicles, excluding guide dogs.

PERSONAL AND COMPANY CHEQUES
Personal and Company cheques will not be accepted as payment for rentals at the time of pick-up. These must be received by Maui 14 days prior to commencement of rentals. Personal or Company cheques are not acceptable as the refundable security deposit.

DISCLAIMER
Illustrations and text in any of our brochures or website are a representation only of the vehicle depicted. Variances in the vehicles offered for rental may occur due to substitutions made by
Maui or modifications and/or upgrades to the vehicle design made by the manufacturer.
